Limited Liability Indemnity

What we supply

We supply exercise equipment. We do not assemble it, install it or supervise its use. Anything built in your home is built by you or by someone you engage.

What is your responsibility

• Assembling the product as the supplied instructions describe, and checking bolts and fixings before each use.
• Using the product within the manufacturer's published limits, including the maximum user weight.
• Deciding, with your doctor if you have a health condition or are pregnant, whether a piece of equipment or a type of exercise suits you. Nothing on this site is medical advice.
• Keeping children and pets clear of equipment in use, and folding or storing machines safely.

What we do not exclude

Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

Nothing here limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

Limitation of our liability

Subject to the section above, and to the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by misuse of a product, by assembly or use contrary to the instructions, or by normal wear and tear. Where we are liable, our total liability in connection with an order is limited to the price you paid for the goods in that order.

Business purchases

Where goods are supplied for the purposes of a business, the parties agree that the Consumer Guarantees Act 1993 does not apply, as section 43 of that Act permits. In that case our total liability is limited to the price paid for the goods, and we are not liable for loss of profit, loss of business or any indirect or consequential loss.

Website availability

We try to keep the site available and working, but we do not guarantee uninterrupted or error-free access, and we are not liable if it is unavailable at any time.

Your indemnity

You agree to indemnify us against reasonable losses, costs and claims we incur as a result of your breach of our terms, your misuse of the site, or your infringement of another person's rights through your use of the site.

Third party content

Where this site links to another organisation, we are not responsible for what is on that site. Where we describe general practice, including the law, that is information rather than advice.
